The fact that you would have to go through the trouble of court is another story, though.

Good advice is to not put yourself in the position to have to worry about it.

Really? I think it probably would. I would think both women would get some sort of slap on the wrist, but judge would probably give ‘mom’ custody of the child and request child support payments from ‘dad’ with the excuse of ‘best interest of the child’.

I don’t know what the right answer to this is, other then do all you can to prevent it from happening. What’s it happened though, it’s hard to really give full justice to the man without harming the child. Perhaps the best you could go is allow the man to choose how he wants to handle it. He could choose full custody and require child support payments from mom, choose no custody and wash his hands of it all, or somewhere in between.

Narwhal, at the moment, if you are believed to have slept with the girl, even if she sperm-jacked you, you have to pay up. This is new ground, and I haven’t seen it result in court yet. I assume the guy still gets the shaft in the end, being that is how the system is set up. I am sure we will find out soon enough, as several have fallen for it already, but we just haven’t heard of the court results if any.
