I can affirm this is true in any state with a community property law. Even though my house was bought long before marrying ex-2 and her name was not on title, my lawyer affirmed by default she was entitled to half of current value.
You can petition court for a more equitable split, but it is entirely up to judge.
Part of the negotiation in my divorce was what I would give up in return for her to waive her interest in MY house.
People I tell this to (usually as one of reasons I won’t marry) don’t believe me because it is so unfair. They don’t want believe it’s true.
And guess what? Same law applies to your 401K. My ex also had to waive claim on that. Although my lawyer said judges are much more willing to allow a man to keep his pre-divorce 401K balance.
