hey mgtower i’ve got a gem for you. in NY state a new form of family court was created in the NYC & Borough area. A total c~~~~~~~~~ asshat judge that wanted to create a new position for himself observed what they were doing down there and adopted the new court up here in my county of NNY.
It’s called Integrated Domestic Violence Court. Anytime that a crime is committed within a domestic setting and the “victim” also petitions family court within a given amount of time, the case is placed in this new IDV court.
Judge Asshat is the supreme court judge of this county as well as the standing family court judge. In IDV court Judge Asshat presides over both the criminal court and family court. It’s treated as one case to the judge but the defendant has to pay for representation for two separate court cases. All of the family court hearings are pushed through immediately before any type of result comes from criminal court, so that the defendant would be forced into family court trial before there’s even more than an initial appearance in criminal court. the charges in criminal court are basically treated like convictions in family court.
Here’s where my experience comes into this nonsense. C~~~#1 that I have my son with was basically trying to cut my b~~~~ off/cuckold me/force me into total walking wallet slavery and I wasn’t having it. One day we had a big fight and I broke a laptop that I had paid for and left. She took the computer in to the State Police claiming it was hers and that she had paid more for it than I did, along with an ak47 that I had with some interesting attachments and large capacity mags.
The gun was not a factor, nor was its use ever implied by me and i never touched the c~~~ either. Although the mags would have been illegal, the gun and the mags were grandfathered in under the current law. This was right after the SAFE act was passed in NY state but it was not in effect yet. The state police arrested me on weapons charges using improper investigative procedure because they never had their weapons inspector check the gun first. they were basically all riled up to make more weapons arrests because of the current political climate caused by the sandy hook incident. the investigator would have been able to establish that the gun was in fact all legal but they skipped right over him.
I was charged with:
2 counts of felony weapon possession
1 count felony criminal mischief because the c~~~ lied about the price of the computer
1 count of harassment, a violation
A stay away and refrain from order was also issued, removing me permanently from the residence that I alone payed for and also barring me from seeing my son at all until a resolution could be reached in court.
Wonderc~~~ got a welfare lawyer because she didn’t work. I on the other hand did not and was forced to seek representation for the criminal proceeding over the family court because i couldn’t afford both. on the first hearing for family court they removed all my rights to custody based on the criminal charges alone. and like i said all of the family court dates were pushed through before anything had happened with criminal court. I was forced to sign an order giving up my custodial rights rather than go into trial unrepresented with all of the criminal charges withstanding.
eventually the weapons charges were dropped, along with the harassment. even though it was my computer, in NY state because i allowed her to freely use it, it also then belonged to her. I had to take a plea bargain, knocking it down to a misdemeanor rather than risking being convicted of the felony and going to jail or prison for a $250 computer that I paid for and broke in my own residence.
I was sentenced to 3 years probation along with 6 months of pretrial release, which is like probation on steroids in lieu of posting bail
the stay away/refrain from order remained except limited contact was allowed to make visitation arrangements for my son
between legal representation, court fees and probation fees it cost about $3500.
this court is the most unconstitutional piece of s~~~. how are you supposed to pursue life, liberty and happiness if something as precious as your family life isn’t afforded the same constitutional rights you would enjoy in civil or criminal court? guilty until proven innocent in IDV court.
i just finished probation last september. and to top it all off, the c~~~ didn’t even want to be the sole custodian. even though that’s still the legal status i’ve actually had my son 40-60% of the time for the last 3 years. she basically tried to ruin me out of spite and for no other reason.
