Wrongfully jailed father seeks compensation after serving seven months…

A WA father suffered “very significant harm” at the hands of the justice system after he spent more than seven months in jail for a crime he didn’t commit.

The Sunday Times can reveal the man is seeking at least $250,000 in damages in the form of an ex-gratia payment for the “devastating” blunder.

The man, who cannot be named for legal reasons, was sentenced to 40 months jail after being found guilty by a jury of sexually penetrating a child who was a lineal relative.

He served seven and a half months before the Court of Appeal overturned his conviction last July.

The complainant was the man’s son. The boy’s mother, who is the man’s ex-wife, made the allegations to police in 2013 in the midst of a Family Court battle about access to the boy.

In her Court of Appeal ruling, Justice Carmel McLure said she had “doubts about the credibility” of the mother’s evidence and that there was a “real risk” the complainant’s evidence was “contaminated” by the mother.

This week, the man’s lawyer Neville Barber lodged a formal application to the Attorney General Michael Mischin for an ex-gratia payment.

The 16-page application says the case is “far beyond a situation of a jury getting it wrong”.

The application states police made no attempt to “carefully scrutinise the circumstances giving rise to the allegation” and that no consideration was ever given to the possibility it was concocted.

“It is submitted that state authorities time and again had the opportunity of properly assessing this matter and making informed decisions which would have averted the devastating outcome. None of those opportunities were taken,” the application reads.

“There were a series of deficiencies in the management of this matter from its inception to its conclusion. Because there were a series of deficiencies … there were also a series of opportunities for the authorities to correct those errors. Very regrettably, the authorities failed to take up any of those opportunities.”

Mr Barber told The Sunday Times he hoped his client’s ordeal would “contribute to a change in the mindset of authorities” to ensure other innocent people were not jailed.

A spokeswoman for Mr Mischin said applications for ex-gratia payments were carefully considered.

I don’t know if you live in Washington State, but this is one of the most gynocentric states in the US. There is no end to the horror stories I hear of menwho get divorced in this state. I have even had one guy tell me that the judge pretty much concidered him a rapist and the sex offender from the beginning of the divirce proceedings. I have known that marriage was off the table in this state well before I had even remotely started researching the redpill.

Almost every divorce I’ve ever been close enough to to know the details about, the woman always comes out with bulls~~~ allegations completely out of spite. And usually says the guy had a small dick.
