Ontario Court Justice Marvin Zuker changed the landscape of sexual assault and the criminal justice system on Thursday.

He found York University student Mustafa Ururyar guilty of sexually assaulting fellow PhD student Mandi Gray.

“The myths of rape should be dispelled once and for all,” he announced near the long-awaited end of his verdict. “It doesn’t matter if the victim was drinking, out at night alone, sexually exploited, on a date with the perpetrator, or how the victim was dressed. No one asks to be raped.”

“Does the woman rush to the police right away or wait days, weeks, months? It doesn’t matter, Zuker said. There are plenty of reasons why victims wait or don’t report at all. Does she remember every gruesome detail in “a piecemeal fashion, rather than in a neat chronology?” It is understandable, people only remember the gist of what happens and trauma causes memory fragments, he said. Does she lie stiff with fear, and not claw at her attacker or scramble desperately for the door during her rape? And if she doesn’t, should she be disbelieved later?

“This is ludicrous and contrary to the way in which victims behave when attacked,” he said.

Like in most cases, there were no witnesses to the rape. There were no obvious physical injuries detected by a sexual assault kit Gray had done the next day. There were just the two people’s words.

Zuker ruled Gray “very credible and trustworthy” and Ururyar’s evidence “a fabrication, credible never.”

I read about this and remember shaking my head over it. First things first it is no way defending rape or as supporting the act. A man should be punished for rape if there was evidence for it.

In this case based on what was written in articles (I searched and more than a few sources) there is no clear indication that he forcibly penetrated her. Nor any mention that she resisted or verbally communicated against having anything sexual with this man.

They had been having sex on and off for a 2-week period and she invited him for a night out saying there might be ‘hot sex’ to follow. Granted, this isn’t a defence but sex was on her mind and provided the lack of evidence and he says she says… it is not beyond reasonable doubt that she denied his sexual advances or verbalized her wish not to engage in any sexual activity. Despite “her undressing and slipping under the covers in his bed at his apartment” where he soon joined her, I presume they started making out and had sex. May be he raped her. May be she is upset that after sex he said this needs to stop. But where is the point where she felt violated… how does a man know that the woman who came over to his place, undressed and slipped in his bed would feel victimized by rape … Based on what? Forget the aftermath. What did she specifically say or do that hinted that she didn’t want to engage in sex? What she thought at the time especially in this case when they had already been having sex for 2 weeks need to go beyond a reasonable doubt to ruin this man’s life. If consent is not presumed nor is forcible entry if the woman doesn’t give any hints or verbal cues that she doesn’t want to engage in any sexual act.

The judge states and I paraphrase that the victim doesn’t need to act in a certain fashion during or after sex for it be deemed rape. So technically any woman who didn’t sign a consensual sexual act agreement or was video recorded giving her consent can turn around and call rape to ruin a man’s life.

This will be challenge in court by demanding the court to define exactly what legal consent for sex is. Because if the courts refuse to define consent, then all sex is illegal. Including, sex between women.
