It has been a full 5 years since my XYF took me back to Federal circuit court.
My daughter is 16.
Last year My daughter was at a $14000 a year private school, missing 30 days due to absence and was late 50 days. I have the precise figures as I was given access to the school portal. She failed miserably, turning up to 2 of her 7 exams. A poorly kept “Secret of success” is that students not prtforming well are culled at year 10 level and not allowed to “degrade” the average mark of senior school graduation.

My daughter is now enrolled at the public school, which is a good thing.

The court case is about her passport expiring. My XYF wants to Take the children on a one month European vacation in third term. My Daughter is also to have 3 weeks of home stay with a French family in 4th term.

She is self representing . The XYF has no Idea that the Principal of the public school has been my longstanding patient of 18 years.

So the poll gets down to : Given that we can expect 3-4 weeks absence, is allowing 7 weeks of international travel a reasonable action given that the student is failing? Is it reasonable that I can expect my daughter to at least graduate high school?

To help you along, a similar court action occurred 5 years ago. The lefty bitch magistrate steam rolled my objection and allowed 5 weeks travel overseas when my son was in year 9 (he was struggling too). The outcome: within 6 months he was disengaged from school, wagging class and was thrown out at year 10 with no assessment or report. He has an IQ of 130. The latest application states he is studying to be a Teacher of migrant english (as a second language). His full time Job? He is working a block away from his malicious mummy at the child care centre he was raised in. I found this out yesterday because one of my patients daughter is his boss. So a 20 year old son is doing “Daddy Day care”.

A Few other points
In her sworn affidavit the XYF states she gets no child support.
The court proceedings are on the 4th anniversary of my mothers passing.
My XYF has never acknowledged her children’s grandmothers passing.
I was thinking about asking another patient who has almost completed her legal degree and aspire to be a barrister in family law matters to represent me. The rules of court says I am allowed to have a support person at the bar table if I self represent.

I’d go against the mother for piece of mind down the road,
when the courts rule in the mother’s favor and the daughter goes to Europe, then goes missing, then is found dead, or stays gone missing for decades.
Then you can reflect upon the fact that you fought this,
and her death won’t plague your conscience.

Yeah blade, I had a one hour phone consult with the law student. We are going to draft consent orders so the child gets a passport, but it is limited so she can’t take the kid out of school to ponce about Europe. I am waiting to hear back from the Principal about the school policy and to whether it is consistent with Government truancy regulations… Unlike at the private school, there are defined expectations of school attendance otherwise they can ex-spell students.

I dont know if its still in working . My first court order in 2009 i bypassed the system . Told the ex lets make an order with no bulls~~~ . I waited for the rite time . Got a lawyer to draw up the papers got her to write a letter of agrience and the lawyer had a process serve her as she was willing to sign then had it sent to the court in agrience . Some way there was anyway and lawyers never brought it up .

Fight it. Your kids future is dependent on their education, not vacations. They may hate you now for stopping their fun, but if they succeed, they will thank you for it. It is a gamble, but active parent participation trumps passive acquiescence. If your daughter’s life goes south, you tried.

A co-worker recently told me, "If you want to see who someone really is, divorce them." I have found out how true this is. When your wife drops the façade of being the caring partner, you will witness all of the greed, hate, and spite that she has masked. It is truly breathtaking!

I think being known as the “mean, vindictive dad” for not letting the kids go to Europe is going to bite you in the ass.

I recommend to allow the passport renewal “against your better judgment”.

Let your kids know you think it’s a very bad idea to blow off school, but you don’t want to stand in the way of the travel experience.
Going to Europe will probably broaden their horizons.

If you can get the principal to deny her leave from school, without mentioning your input, it might help the overall situation.

I think your kids are currently f~~~ed until they get away from mom and begin to get their own s~~~ together.

I’ve been through similar situations, they are obviously, very common in divorced situations.

Don’t bother pretending to be the “cool dad”.
It’s only “cool” to the kids while they are just kids.

They will only appreciate the boundaries you set once they are older and have kids of their own.

I respectfully disagree with those who have told you to give up and your children are “lost.”

My own mother turned me against my father for 30+ years. It wasn’t until I matured that I could see her treachery. The same goes for my sister. During the last 20 years of my Dad’s life we repaired the breach that had been made by his bitter, vengeful wife and he passed away knowing that his children loved him.

Dude, you have not lost your children. I do think you have to convey your concern. Kids aren’t completely stupid forever. Tell them that taking School seriously will lead to having many more choices in the future. What money, education, and power gives one is choice.

Clearly, their mother doesn’t see that. There are lots of hills you can die upon… maybe this isn’t the one with the most impact. If you want to have influence later, it may be easier to let this one go. Only you know the situation.

My son never seemed to have that competitive fire in his belly. I worried over it all through High School. I continued to encourage him and it finally caught. I could only promote the conditions in which it could catch.

All I can say is that kids will need help, advice, and guidance for the rest of their lives. There is a lot of road ahead to influence if they don’t shut you out because their mother is a t~~~ and they are immature.
