If by postnup you mean divorce decree, you bet your ass it can be tossed out by a judge, at least it could when I got divorced in Washington State. According to my lawyer the f~~~ing c~~~ had 1 year to “reevaluate” and come back at my ass for more (in case ~70% was not enough … f~~~ing judges). As a result I liquidated almost everything left and put the cash into storage (with my dad), and also got lucky that my company moved me to Munich which aided in the liquidation and removing assets from US jurisdiction.
In the end she never did go back to court but somehow the c~~~ actually got my number in Munich and called. When I got the call I just put the phone down on the table and let her talk to the air. No time wasted any more on skanky f~~~ed up holes.

You mean divorce decrees? The answer is yes, although the details depend on the jurisdiction.
There’s a famous case in the UK in which the ex-c~~~ re-opened the divorce settlement something like 20 years after the decree. It seems her husband… sorry, I mean victim… had built a multi-million pound business since the divorce and she now wanted a bigger slice.
She got it too.
Remember, throwing out prenups and divorce decrees only occurs when it benefits the woman. It doesn’t happen the other way around.

The divorce court judge is like a king/queen. This person can modify or shred all contracts. The only way prenups and postnups work is: both parties are fair-minded and have some integrity during a divorce. Good luck with that.

It particularly is true when it comes to orders of child support. She can take you back to court to ask for more between now and 18 years old.

From what I was told, post-nups can be thrown out by the simple fact that the spouse was “under duress” when signing even with advice of counsel. The pre and post nups have little effect nowadays it seems. A prenup was thrown out a few years ago in NY state. A state which always had some of the strongest prenup enforcement laws. The reason, because he promised (verbally, not in writing) to toss the pre-nup after 10 years or so.

The only way to protect assets is an irrevocable trust. If done in enough time prior to a wedding, and no cominggling of assets, the assets are safe.
Yeah, it sucks that contracts can be thrown out by judges.
