However, the video is misleading. If the high court overturns a prenup, that doesn’t mean all prenups are null and void.

One needs to look at the circumstances of the case.

Here’s an important aspect of prenups: you need to live what the prenup says. If you don’t, the court will set it aside.

What do I mean? Marriage laws assume and impose financial interdependence on married couples; hence, the reason for automatic division of assets and alimony paid by the bread winner. A prenup essentially states that there won’t be a financial interdependence; rather, there will be financial independence. Therefore, making division of assets, and the duty to support the other void.

If you sign a prenup and live financially independent, then you should be “okay” when the prenup is challenged. However, you’re f~~~ed if you had a prenup, but your relationship was one whereby she was financially dependent on you.
