A Southern California man who built a sizable business out of recycling electronic waste is headed to federal prison for 15 months after a federal appeals court in Miami rejected his claim that the “restore discs” he made to extend computers’ lives had no financial value, instead ruling that he had infringed on Microsoft Corp. to the tune of $700,000.

The appeals court upheld a federal district judge’s ruling that the discs Eric Lundgren made to restore Microsoft operating systems had a value of $25 apiece, even though the software they contained could be downloaded free and the discs could only be used on computers that already had a valid Microsoft license. The U.S. 11th Circuit Court of Appeals initially granted Lundgren an emergency stay of his prison sentence, shortly before he was to surrender, but then affirmed his original 15-month sentence and $50,000 fine without hearing oral argument in a ruling issued April 11.

Lundgren, 33, has become a renowned innovator in the field of electronic waste, or e-waste, using discarded parts to do things such as construct an electric car, which in a test far outdistanced a Tesla on a single charge. He built the first “electronic hybrid recycling” facility in the United States, which turns discarded cellphones and other electronics into functional devices, slowing the stream of harmful chemicals and metals contained in those devices into landfills and the environment. His Chatsworth company, IT Asset Partners, processes more than 41 million pounds of e-waste each year and counts IBM, Motorola and Sprint among its clients.

The issue at hand is that the systems in question come with a license for the operating system. Providing someone with a restore disk is simply providing someone with something that they hold a license for to begin with. These disks only function with machines that are licensed, this has nothing to do with piracy but rather using legitimate software. That has been placed on the market when the system was sold. It like GM suing for patent infringement when you sell a used car.

Sorry, but Microsoft is totally in-line with the law on this one. I’m a computer repair technician and a licensed Microsoft refurbisher and I can tell you that unless you have the ORIGINAL restore media that came with the computer (not a copy) and the COA, you’re committing copyright infringement by not buying a refurbisher’s license for every computer you resell.

It’s stupid, and the law needs to change, but you can NOT reuse the COA or the license by itself, nor can you use the CD (original or a copy) by itself. You need to have both. If you don’t and you sell a refurbished computer, you’re just committed copyright infringement. If you sell the CD’s and enable others to do this, it’s the same as copyright infringement. Microsoft claimed the $20 per CD price because that’s how much a refurbisher’s license costs and all these computers should have been provided with a refurbisher’s license before being sold.

Sadly, Dark Ryu is partly correct. The Licence does state that if you are a refurbisher, or a person that sells these machines, the original license and the legalese does state that as a reseller, you do have to pay the $20 fee.

FreeGeeks in Portland Oregon ran into this issue as well with the Used Macs they were selling. They tried to push a version of Linux for the Mac with these machines, but they never worked right. So they just put OSX on them.

The PC’s however, all came with Linux.

But it still irks me that a guy can write a script that will be on a USB stick or the hard drive, pull the image from the web site, and do the install all by itself, and NOT get in trouble.. OR

Just not include any software, and just load the images at the shop and not have any issues or anyone being the wiser.

But to BURN a copy of a CD for the customer as a spare? That’s sort of messed up.

But whatever. 13 months in JAIL. But you can kill people and get less time.

It’s just a f~~~ed up justice system. But the one with the most money wins. Oh well.

Why not format the disk and re-sell the parts, or the computer with linux, or without OS? This “licensing” stuff is disgusting. Paying for a software that is doing who knows what in the background, as closed source and intellectual property and blah blah. Probably also uploading one’s stuff to the ‘cloud’ (other people’s computer). Linux does not do this. And Linux is (was always) more wide spread among huge web servers and scientific supercomputers, but I am using right now Linux Mint to browse web on my laptop. And it is (in the recent years) no more a pain in the ass to get it configured and up and running, and it can do all the everyday stuff. Also comes with a lot of free and good apps. Gimp, Libre Office, Openshot video editor, VLC media player, Firefox, just to mention a few. There are also some tweaks to run games on it, an there are some good games that run natively on Linux.

Give this man a Nobel Peace Prize. Recycling old electronics and saving them from the Garbage Dump, actually will land you in jail today.

Absolutely, INSANE.

A time is coming very soon where repairing electronics will be illegal. You will be forced to throw it out and buy a new one. Then you will be taxed and penalized for causing pollution by throwing it out.

Its a hopeless situation. The Electronics Industry is a nightmare. The Industry decided it was more profitable to cancel their repair departments and have everyone throw the old equipment away. Even for simple things like a blown SMD Fuse. THROW IT AWAY.

Then they noticed an increase in lead at the garbage dump (Gee Whiz, I wonder why?). The idiots then decided to remove all the Lead Solder because of the lead ending up in the Garbage Dumps. Now we have poor solder joint quality and tin whiskers. More failures and more electronics ending up in the Garbage Dumps….oh yeah and the best part. The Tin Whiskers cause Cars to Crash and Satellites to go down.

Way to Go!!!
