Female judge new to bench shuts down his defence and railroads him into a guilty verdict.

Appeals court acquits him and ‘respectfully’ criticises judge, finds the whole thing a ‘substantial miscarriage of justice’. Bit late now.

While awaiting trial on sex charges, Kenneth Bell was savagely beaten in jail and suffered severe brain damage.

By 2016 Mr Bell was well enough to face a judge-alone trial in the NSW District Court, and was found guilty of raping a woman while giving her a nude massage the morning after a party at her house.

But the NSW Court of Criminal Appeal acquitted Mr Bell, finding there was “real doubt” he had committed the crimes, and that doubt should have been shared by trial judge Siobhan Herbert.

“The trial judge’s reasons do not dispel that doubt but rather fortify it,” said the appeal judgment, made public on Monday.

The court pointed to the alleged victim’s inconsistent statements, “significant anomalies” in the evidence, and a “sense of unease” about the course of the trial.

Mr Bell was accused of digitally penetrating a 28-year-old woman despite her refusals and touching her inappropriately during the massage one morning in April 2013. He was attacked in custody just weeks after his arrest.

The woman’s ex-husband called police after she sent him some concerning text messages about Mr Bell, and officers arrived at the house in the evening.

She did not tell police Mr Bell was still in her home and, when they later found out, she said he was there to fix her television antenna late at night.

Her neighbour told court the woman said she was confused about whether Mr Bell should be facing charges.

“I’m not sure if anything happened,” the woman was said to have told her neighbour.

There was also evidence the woman had a “motive to lie” about the alleged rape to protect herself from her controlling ex-husband.

The appeals court found Judge Herbert made an error in finding some of Mr Bell’s recorded phone calls from prison were admissions.

Instead Mr Bell was clearly describing the details of the woman’s allegations in the calls to relatives, the court said.

The appeals court also found Judge Herbert had interrupted the defence barrister, disallowed some questions, and narrowed a course of questioning so it was unfair to Mr Bell.

“Our assessment of the evidence in the present case has left each member of the court in doubt as to the applicant’s guilt.

“With great respect to the trial judge … we have concluded that there were so many significant inconsistencies and anomalies in the evidence as to point unequivocally to the conclusion that the verdict was unreasonable, or cannot be supported, having regard to the evidence.”

Damn. As we’ve said before sometimes not even the woman, but people associated with her will cause you trouble. Some damn simp ex got all butthurt because some other guy touched his EX. Really? That’s some straight up s~~~ right there. Of course, the Judge screwed it up which got him screwed over. What we can all learn from this is:

Judges can live with their mistakes. You may not be so lucky.

If you didn’t think men could be vindictive bitches, Now you know better.

You can be in the right 100% and STILL get locked up without having a chance.

If you think this judge will be held accountable for this, don’t hold your breath.

It will be near impossible for this guy to get any justice, even considering what he’s been through. At least he won the appeal though.

Digital penetration, that one I had to look up. It doesn’t mean what I thought it did.

Many modern criminal statutes use the term sexual penetration when referring to unlawful sexual acts because it is a broad term encompassing (unless otherwise qualified) any form of penetrative sex, including digital (meaning with the digits, i.e., the fingers) or with an object, and may involve only the most minimal penetration.

Mate I wish I could, unfortunately I’m not quite able to stop myself wanting to f~~~ hot young legal age women yet, but you’re right about Oz being a feminist f~~~ing dream. Stuff like this doesn’t make me lose faith in women, maybe I did at some point, but it’s more that I understand women, I know what they are.

However, what it does is give me zero faith in society and our justice system. I know all of it is bulls~~~, because only a system that ignores justice could ever give women equal weight to men in anything.

No just system would ever appoint female judges or attorneys or politicians or bureaucrats or law enforcement. Female nature is not new, it was figured out thousands of years ago, and civilization was constructed with female nature in mind. Women lie, and women abuse power, and women have no decency or notion of honesty or fairness. They’re incapable of it. So any system that relies on female honesty and fairness can’t possibly work. So the system purposely ignores what it knows about female lies and deception, and instead chooses to willfully and wrongfully punish innocent men.

This isn’t the first time, it’s not the last time. Usually it’s covered up better, this time it got through a little is all.
