Gentlemen,
I’ve just discovered my ex has planned, booked and paid for a “holiday” to Malaysia (a non-signatory to the Hague Convention on Child Abduction) with our children and her bf without informing me.
I’ve managed to stop the children from having passports issued to them, but has anyone got any experience with how to deal with this?
Where I live (Australia), this action is punishable by imprisonment…. my lawyer is licking his lips….

I was worried about my wife running off to Japan, her home country, with the kids. We got the kids passports right after they were born. Japan recently signed on to the Hague although I don’t know if they’d actually do anything. Nobody has tested them. I still tried to block her from leaving because while we were married she had asked me before if I would be angry if she ran off to Japan with the kids. She went to court and was allowed to go despite the separation agreement saying she couldn’t. I didn’t know about the court date until too late. She went. There was a scare when she extended her trip without telling anybody but then she came back. Too much free money for her in Canada.
A former co-worker was not so lucky. They weren’t married and baby mama ran off with the baby. A private investigator tracked her to Belize and they’re trying to figure out how to get her into custody. Long, convoluted story.
I wouldn’t take the chance if I were you. Sounds suspicious and there are plenty of other beach areas in Asia.

She is not very intelligent, so it is possible she just plain forgot to tell me, but…..really, who the f~~~ would do that?
I’m going to refuse to sign the passport applications until she provides a written statement stating she will return to Australia with the kids, but even then I still have my doubts…

Lawyer up, hunker down. and don’t give an inch.
As an aside. Use the same legal and political precedents women are using to have children returned from other nations.

I don’t want to contradict a man with a lawyer, but you do realise half the broo-ha-ha of the recent 60 minutes thing was that in Australia it is NOT a crime to go haring off to the other side of the world with your kids, contrary to court orders?
The reason for this was exposed in the last Malaysian adventure that you doubtless remember – woman gets custody here, husband (a prince, son of the Sultan of Selangor or somewhere) got custody there, international shenanigans result.
That mother became an advocate for parents who lose their kids but I saw her interviewed one time and she let slip (among much excuse-making) that 70% of the time it’s the mother who defies the court orders and illegally snatches the child. Hence to criminalize this would criminalize women, and Oz is too gynocentric to ever take such a step.
I’d get a legal second opinion. Hope everything works out for you.
