    I moved out of this small apartment I was renting for 450$ a month, I had a 400$ deposit down on it. I just got the check from him and it was 75$ cleaning fee and 125$ floor repair. The floor was concrete with like a laquer on it that flaked off in two areas.

    I vacuumed and mopped before leaving (no carpets) and the floor seems normal wear and tear. This guy is kind of an asshole but given we were family friends of sorts I thought we would leave on neutral terms.

    I may do small claims court or something, what should I do?

    Every rental I’ve ever been in, the deposit was basically a write off. Consider your next rental accordingly. Be happy you got anything back. Don’t waste your time with legal s~~~.

    They pull that sort of fraud time to time. I had similar issue with a Internet Connection company and once I moved they charged me for the modem/router etc. Luckily, I had the receipt with the bimbo’s name and signature on it confirming I had returned the equipment.

    I agree @ Solomon’s Wisdom it is not worth your time or money or peace of mind to take him to court. You can ask nicely and point out what you said in your post and hope for the best. Don’t confront him. Write it off at the worst.

    Why not? Filing fees are only 30$ looks like. This guy was an asshole, he pretended I didnt give him any deposit until I showed him the paper with the 400 on it.

    At the very least I might bluff him about considering filing against him. It was a pretty s~~~ty place, dealt with c~~~roaches on my face all the time.

    You need to take a photographic schedule of condition at the start of your tenancy and at the end of your tenancy showing every room, each wall and floor ceiling and everything in it.

    Then if the landlord pulls any nonsense you send copies of the photos and say I will have my deposit back within 14 days failing which I will issue at court and costs will be $XX amount.

    You will get your money straight back. It’s a common tactic by landlords. I used to have a standard letter I used whenever I rented. They always settle when they realise you have photographs.

    On this particular occasion, if you don’t have photos it’s your word against his and do you really want to get into a big legal battle?

    I don’t think $200 is a terrible loss. I would of called him a very bad name and moved on.

    If you want to get this done easy, tell the landlord you will not sue, but you will file a complain in a public administration that deals with this sort of problems.
    An inspection is something that the landlord will probably want to avoid, especially if this apartment is not in a good condition and it may in fact be illegal in some for or way (the landlord will know if it is, you will see it rather clearly in change of attitude).

    No reason to “scare him” or “shout” or even “tell him he will be sorry”.
    Just tell him you disagree with that decision but since you dont have the time to deal with that sort of fraud, you will give the information to whom it may concern.

    That is ofc if you want to even do that, you might just forget about the 200 bucks and write a negative opinion on his rent on the internet to warn future users.

    No, I want to take this guy down. I was ready for a clean break, but the fact he pulls this chicken s~~~ stuff is a final straw.

    Interesting to see its a common tactic. Do I want to ‘show my hand’ by showing him pics at this point? I am going to write a letter essentially saying I am shocked and want my other 200$ back.
