    This was brought up in another thread. I didn’t want to hijack the thread so I started a new one.

    Another brother posted how much debt he is in b/c of his emancipation from psycho pumpkin.

    It got me wondering, why doesn’t brother file for bankruptcy? Well, of course the answer is, it wouldn’t do him any good or he would have already done it.

    I know there are somethings that cannot be part of bankruptcy, like child support, tax debt, student loans etc.

    So my question is, why won’t it do him any good?
    To the lurkers that have not married pay real close attention to the answers (if any).

    BTW I don’t know the answer. This isn’t rhetorical.

    If a family court judge (at the state level) issues a court order requiring a guy to pay for certain things for an ex-wife:

    Chapter 7 and Ch 13 in federal court (bankruptcy), does not nullify a state court judge’s order.

    But in many cases, state family court judges like it when a guy claims bankruptcy on all of his debt that he is allowed to discharge in federal bankruptcy court.

    Because it frees the guy up financially to continue paying what he is court ordered to pay as a result of a divorce (alimony, etc).

    If he can juggle all his financial commitments then he is probably trying to retain his credit rating as it comes in handy for leasing apartments/buying houses, car loans, and Life in general.

    Of course, if he can’t afford to pay his debts then his credit rating will go to hell, and he may be better off filing bankruptcy.

    It’s a case by case situation/decision.

    oooo bankruptcy, it sounds so good to flush all my debt away. I wear my debt like a suit of armor. The c~~~ can’t come after me for more money if I already have a low income and a s~~~load of debt. mmm mmm mmm mink lined debt blanket, soft and cushy, looks good in any season, always fashionable, the ladies can’t get away from it fast enough from it’s mangy cat pelt outer coating of stink.

    When you have nothing, the court struggles to punish you. When you have everything all you can do is lose. I have to turn over tax forms and an annual financial statement. I have to turn in proof of life insurance. lol debt is much more than the insurance policy pay out. I made the c~~~ my executor, but neither she nor the kids are getting anything. They are to sell all my property, and donate it all to a charity run by a direct competitor of the company my c~~~ works for. lol everything I own fits in 3 laundry baskets.

    I need to maintain a good credit rating, as it affects interest rates, ability to get apartments, loans, and insurance. So, I live on the ragged edge of homelessness, instability and poverty, three years to go, brothers.

    Sky o buddy, you are correct, remove the other debt that gets in the way of the court ordered bulls~~~. Then the c~~~ takes you back to court to pursue that freed up money. Exactly what my attorney told me, never ever pay off the other debt, run up an amount equal to what you can afford to pay and barely live on, pay it slowly, no big pay off, slow payments over time. I am not an attorney, and not advising anyone to do what I do. What I do is a red pill that would kill most men. Do not follow in my footsteps. Go your own f~~~ing way.

    I have faced the possibility of bankrupcy several times. Right now is one of those times. I have the option to take it over a $70k debt that I never took out and never benefited from (it is a long story) – it is a remnant from my divorce 7 years ago… It is tempting.

    BUT – I think I will not take the easy option. Because life is too short. It will f~~~ up my credit rating and then cannot borrow anything for 5-7 years. Cannot sign up for a post-pay mobile phone plan. Cannot be a company director for 3 years. Cannot buy real-estate. Cannot travel overseas without permission of the bankrupcy trustee… I will try to negotiate an installment plan, but I need it to progressto the courts to do that , as the writs have been served already.
