A coworker recently told me about a guy he knows. This guy was having sex with his girlfriend and typically used the pull-out method. I’ve already gotten a vasectomy. I just thought it was worth mentioning. I can also see how it would happen, the woman doesn’t have to be strong enough to actually hold him in place, just strong enough that if he tries to get up she comes up with him, which would necessitate violently shoving her off. Most guys won’t do that. Especially right before a bust when you have no sense.

@ogre, I completely believe that it’s possible. You are considering all the factors of the situation.

– He is not likely in a position where he can use much of strength to get away. He did not know he had to get away from her grip so was surely not in a ‘stance’ to best accomplish that.

– Again, he didn’t know he was going to need to have resistance when pulling out, so he would have only have applied enough force to pull out, not to lift a 100+ lbs.

– I would imagine his goal was to pull out at the last possible second. Would he have enough time to recognize what was happening, shift his position if needed, and then reapply the force needed?

– Hindsight is 20/20. In that instant, he may be thinking that perhaps he misunderstood when she said she wasn’t on the pill. Or perhaps she was going to release her grip at any instant. His first though may have been that attempt to break free could inadvertently hurt her or just upset her. Point is, it’s completely understandable to miss assess the situation and make the wrong decision, since you only have a second or two to do it.

As for claiming it’s rape, no one you win that case. Everything is against you.

-It’s her word against yours. No judge will believe you. In fact, if she claimed she was raped after he did, she would probably win.

-He has a motive for lying…trying to get out of support payments.

-The sex was consensual, up until the point that it wasn’t. Did he even have time to say ‘no’. If the situation was reversed, where he said he was going to pulled out and didn’t, could she then claim it was rape?

– Even if you do win a rape charge, should that remove child support requirements? He can’t force her to have an abortion. Is it better if the state pays for the kid? What’s best for the kid?
