Gregory Elliott’s Defense Lawyer’s Final Submissions

Nevertheless, Ms. Guthrie testified to the following during cross-examination:

Q. You knew that … you knew personally that Gregory Elliott was responding to defend himself?

A. He’s entitled to defend himself to the world, but not to me.

A. He’s not entitled to an audience from me, Mr. Murphy.

Q. Okay. And that’s what it comes down to, would you agree with me, that you don’t believe that Mr. Elliott is entitled to defend himself to you?

A. To me. Yeah … no, I don’t believe he is.

Q. Right. Okay. No matter what you say to or about Mr. Elliott,

A. There were a lot of people who backed me up on what I said about him, a lot of people, Mr. Murphy.

Q. Two of whom are …

A. Two of the dozens, yeah.

Q. Two of whom are the complainants in this case, right?

A. Yes. Yes.

Q. Okay, fair enough. So you felt fearful of Mr. Elliott from the beginning which was your dinner with him in April … on April 19th, 2012, is that right?

A. I felt creeped out by him, and I began to increasingly feel fearful as his fixation on me became more and more apparent, which happened mostly over the summer, and toward the end of the summer, and into the fall of 2012.

Q. Okay. But, sorry, you just testified that depending on what definition of fear we’re using, you felt fear when you first met Mr. Elliott, and you first met Mr. Elliott at dinner in April 2012, correct?

A. Yeah, because feeling creeped out is a type of fear.

Q. Okay. So you did feel some fear of Mr. Elliott starting at that dinner …

A. Yeah.

Q. … on April 19th, 2012?

A. Yeah, but unfortunately we live in a world that teaches women to second guess those feelings. Oh, did I really feel creeped by him … oh, because if you can’t point to a specific thing that the person said that … or them grabbing you or doing something very specific, then everyone questions whether you really have a right to feel fearful. So I questioned it, and I wrestled with my feelings about things, but toward the end of the summer, yes, definitely.

Q. Let’s take you to the [email] just above that, please?… This is April 21, now, 2012…at 9:36 a.m. “Thanks, Steph. No need to credit me for anything. I would have loved to have provided your project with a great logo and poster. Maybe next time. Love Greg.”

A: Yeah.

Q: Right? Does that sound like a very angry man to you?

A: It sounds like a man whose [sic] masking some anger. All of these exchanges do, and as you might recall me mentioning, I too was masking some dislike, some negative feelings. I mean none of these exchanges use insults or all caps to scream at each other, but there is a seething undertone to it.

Q: Okay. So I’m assuming…

A: And anyone with some social intelligence I think would see that.
